EXCLUSIVE LIQUIDATION BUYER’S PREMIUM ADDED TO ALL LOTS PURCHASED

  • All buyers must have a bidding number/approved for registration and shall supply Exclusive Liquidation with their name, address, phone number and if so requested a bank reference. A form of picture ID is required to verify information given.

  • The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidder, or in the event of doubt on Exclusive Liquidation’s part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resale the article in dispute.  In event of a live auction, the successful highest bidder shall be the buyer at the “hammer price” and any dispute shall be settled at the auctioneer’s absolute discretion. An audio recording is made of each auction to verify auction results, if necessary.

  • The auctioneer has the right at his/her absolute discretion to refuse any bid and to advance the bidding as he/she may decide. The auctioneer reserves the right to reject any bid at any time and as his/her sole discretion.

  • All items are sold AS IS, WHERE IS with all faults, without returns, exchange, refunds, credit, warranty or guarantee of any kind. ALL SALES ARE FINAL. There is no warranty of fitness, merchant-ability of suitability for any purpose. Absolutely NO RETURNS. Under rare special circumstances, we allow refund and exchange only if found to be our fault. If an item needs to be returned Exclusive Liquidation needs to have written notice by bidder in form of email to info@exclusiveliquidation.com no later than 3 days of receiving the product. It is Exclusive Liquidation sole discretion to approve any return. Exclusive Liquidation will provide a Merchandise Authorization Number. Any allowed returns must be received in the EXACT CONDITION it was shipped to the buyer. There are NO refunds on shipping, or auction premium. Unauthorized returns will be refused. Under no circumstances will any amount other then the winning bid amount be refunded. Any package refusal by winner bidder constitutes as an unauthorized return and is in direct violation of these general terms and conditions. IF THERE EVER IS A CASE OF A REFUND BEING ISSUED, YOU WILL BE CHARGED A 15% RESTOCKING FEE AND YOU WILL BE RESPONSIBLE TO PAY THE SHIPPING FEES AND BUYER’S PREMIUMS WILL NOT BE REFUNDED. PLEASE BID RESPONSIBLY AND ASK ALL QUESTIONS PRIOR TO PLACING A BID.

  • The auctioneer is not responsible for the condition for any items sold.

  • A 10% BUYER’S PREMIUM (In-House, In-House Absentee, Phone, Online) WILL BE ADDED TO THE HAMMER PRICE ON EACH LOT SOLD AT THE END OF AN AUCTION. THE PREMIUM IS NON-REFUNDABLE.

  • Any State Sales Tax will be paid on 1) The Hammer Price and 2) the 10% Exclusive Liquidation Buyer’s Premium. For all California residents a 10% sales tax will be added to your invoice.

  • All Purchases will be subject to any state Sales Tax unless the buyer provides Exclusive Liquidation with a valid Resale Certificate at the time of registration. Sufficient ID, i.e., a business card, is required.

  • Non-Resale purchases from Out of State must be shipped from Exclusive Liquidation by common carrier, and any state Sales Tax is applicable.

  • All Lots are to be paid in full by cash, cashiers check, bank wire transfer, Paypal (for MasterCard or VISA) at the close of the auction. Auctioneer reserves the right to hold merchandise until a buyer’s check clears. Any items with a “hammer price” over $1,000 and up must be paid in full by cash, cashiers check or bank wire transfer. There will be a $30.00 handling fee charged, each time a payment is returned from the bank for any reason. Bidders agree to pay all costs related to any “charge back” by banks and/or credit card companies, including fees, processing charges, collection cost, attorney and court costs. Any bidder who provides a credit card for charging auction winning bids, and later charges back the charge shall pay the auctioneer a $50.00 charge back administrative and processing fee in addition to the initial amount of the charge, regardless of by check or credit card, regardless of venue. Any person who refuses to pay such charges shall result in a suit for recovery of charges, fees and processing.

  • All bidders, regardless of venue by which they bid, are required to pay by close of day on the auction day event, regardless of the actual day the auction business processes credit card charges, and agree to authorize one charge for the item cost, and another charge for shipping charges. If payment is not received and or process-able with funds available on or after close of the auction event day, the auction house has the right to deem the sale “null & void” and a non-paying bidder feedback will be left.

  • Non-paying bidders will be added to the No Bid list. A non-payment fee will be added to your bill for Legal & Processing fees. A minimum of $500 will be applied. We will turn it over to our collection agency and will prosecute to the full extent of the law. Please do not bid if you do not intend to pay.

  • Return Policy: ALL SALES ARE FINAL. No return, exchange, refund and credit. All items are sold “AS IS” “WHERE IS” without warranty or guarantee of any kind.

  • NO EXCEPTIONS. IF PAID PROPERTY IS NOT REMOVED WITHIN FORTY FIVE (45) DAYS AFTER THE CLOSE OF THE AUCTION DATE WILL BE CONSIGNED TO A FUTURE AUCTION WITHOUT ADDITIONAL NOTICE TO THE BUYER, PROPERTY WILL BE CONSIDERED ABANDONED AND OWNERSHIP SHALL REVERT TO GALLERY. ***SHIPPING CHARGES ARE NON-REFUNDABLE.***

  • The buyer assumes full responsibility for items at the fall of the hammer.

  • NO LOT MAY BE TAKEN FROM EXCLUSIVE LIQUIDATION UNTIL THE AUCTION HAS ENDED, AND PROPERTY HAS BEEN CHECKED OUT BY AUCTION STAFF.

  • Exclusive Liquidation reserves the right to withdraw any lot at any time before, during, or after the auction without liability.

  • All lots must be taken away at the buyer’s expense by the Wednesday following auction. Lots not removed by this time may be subject to a $15.00 per day storage fee, per lot purchased.

  • Exclusive Liquidation will be open until 6pm the day of the auction.

  • The property in a lot shall not pass to the buyer until the purchase price has been paid in full, and the auction is over, but, the lot shall be at the buyer’s risk in all respects from the fall of the hammer.

  • Any representation or statement by Exclusive Liquidation as to description, authenticity, authorship, attribution, completeness, genuineness, origin, date, age, provenance, condition, materials, estimated value, market value, estimated selling price or any other feature of items is a statement of opinion. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kinds as the authenticity, authorship, attribution, completeness, genuineness, origin, date, age, provenance, condition, materials, estimated value, market value, estimated selling price or any other feature of items being sold. Exclusive Liquidation attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. Buyer must make all of his/her personal item evaluations. We recommend prospective bidders examine all items in which they have an interest. By placing a bid, either in person, by phone, absentee or via internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. No statement (oral or written) in this catalog at the sale or elsewhere shall be deemed such warranty or representation, or any assumption of responsibility.

  • ALL MEASUREMENTS, SIZES AND WEIGHTS ARE APPROXIMATE.

  • Bidder’s agree to inquire and conform to any legal requirements regarding buying, receiving, owning or storing an item before bidding on an item. By bidding the bidder professes he/she has a legal capacity and right to buy and receive an item. In some country’s, it is illegal to ship certain items such as Coins, Jewelry, and Gold & Silver, etc. It is the buyer’s responsibility from which you want items shipped, to know whether or not it is legal for us to ship. Illegal items will not be shipped.

  • Bidder’s agree to accept all risk related to purchasing any item at auction and agree to obtain inspections and necessary training in regards to the item ownership or use, exclusive at the bidder’s cost. Bidders accept risk of loss or damage to any item which is won at auction, and in such cases the amount due for the item with all applicable charges shall not be diminished based upon item age or condition, and such charges shall remain fully in force. Bidders accept risk of loss or damage to any item left on auction house property, and/or stored by the auction house pending shipment to the winning bidder. Auctioneer will take all reasonable precautions to protect items held in storage pending shipments but provides no insurance coverage for that purpose and bidder’s agree the auction business stores items completely “at risk” to the bidders and/or winning buyer.

  • Important Notices & Disclaimers – PLEASE READ REGARDING APPRAISED JEWELRY AND LOOSE STONES – Exclusive Liquidation sends them out to a third party for Retail Replacement Value Appraisals, which are the most common. These types of evolutions are written for insurance needs. This would be the cost to REPLACE the jewelry with an item of equal quality and kind, considered to be the current market price or replacement value. This type of appraisal is done to protect you (the bidder) in the event of damage or loss of a valuable item. Our appraisals are conducted by independent 3rd party appraisal firms that utilizes Certified GIA Gemologist. Appraisals should be used for verification of gemstone and/or metal weight, size and grade ONLY, not actual value. Appraisal value should be considered for insurance purposes ONLY, not actual value, as price varies greatly from retail locations throughout the world. Items should not be purchased with the expectation to resell for appraisal rice, or for profit.

  • Illegal items: Any item received for auction which is later determined to be illegally possessed, stolen or with any other claims, will be surrendered to the appropriate law enforcement agency, with all auction fees remaining fully due and in force, and such surrendered shall not void or reduce fees due the auction house from the consignor.

  • There may be minimums placed on some items.

  • The auctioneer is not responsible for INTERNET, software and/or system failures in attempts to execute bidding.

  • In the unlikely event we lose our internet connection, Exclusive Liquidation reserves the right in its sole and absolute discretion to cancel the remainder of the auction.

  • The auctioneer acts as agent only, and under the terms of this contract shall not be liable for any default of the buyer, bidder, consignor, seller, or vendor.

  • The auctioneer reserves the right to rescind, reject, and or terminate any participants, participation in any auction conducted by the auctioneer, with or without explanation.

  • **Auctioneer has final discretion on sale of an item. His/Her word is final**

  • This sale is being conducted pursuant to Section 2328 of the Uniform Commercial Code and Section 535 of the Penal Code.

  • SHIPPING. We do not have in-house shipping or packing facilities. All shipping and handling charges are the sole responsibility of the buyer. If a sale results in a canceled sale, we do not refund shipping or return shipping costs. Please contact one of our recommended shippers, or a shipper of your choice, for a shipping quote prior to bidding. They will need the lot number, short description, approximate selling price and your shipping address. They will pick up, pack and ship your items to you.
